Damage & Liability Policy

1. Pre-Transport Vehicle Inspection

Before your vehicle is loaded onto the carrier's truck, both the carrier driver and the Customer (or an authorized representative) will conduct a thorough inspection of the vehicle's exterior and interior. All pre-existing damage will be documented on the Bill of Lading (BOL). We strongly recommend that you take comprehensive photos and a short video of your vehicle immediately before pickup.

2. Post-Delivery Inspection — CRITICAL

Upon delivery, you or your authorized representative MUST inspect the vehicle thoroughly BEFORE signing the delivery Bill of Lading. If you identify any new damage:

  • NOTE the specific damage clearly and in detail on the delivery Bill of Lading before signing
  • Take photographs of every area of damage immediately
  • Ask the carrier driver to also sign the notation of damage on the delivery BOL
  • Contact Top1 Auto Transportation at +1 (916) 407-9455 within the same day

IMPORTANT: If you sign the delivery BOL without noting damage, you are legally certifying that the vehicle was received in satisfactory condition.

3. How to File a Damage Claim

  • Document all damage with clear, date-stamped photographs immediately at delivery
  • Ensure damage is noted on the delivery BOL before signing
  • Contact Top1 Auto Transportation at +1 (916) 407-9455 or contact@top1autotransportation.com within 24 hours of delivery
  • Obtain two written repair estimates from licensed auto body shops
  • Submit: delivery BOL with damage noted, pickup BOL, photographs, and two repair estimates

4. Carrier Insurance Coverage

All carriers in the Top1 network are required by federal FMCSA regulations to maintain active cargo insurance and liability coverage. Upon request, Top1 will provide the carrier's name, MC number, and insurance provider so you can verify coverage at https://safer.fmcsa.dot.gov/.

5. Top1's Role as Broker

Top1 Auto Transportation LLC is a licensed freight broker, not a motor carrier. We do not own or operate the trucks or trailers used to transport vehicles. As a broker, Top1 is not directly liable for damage caused during transport by the carrier. We will act as your advocate with the carrier's insurance company.

6. Items Not Covered

  • Personal property or belongings left in the vehicle
  • Mechanical or electrical failures unrelated to transport (pre-existing issues)
  • Damage to convertible tops, antennas, spoilers, or accessories not noted as pre-existing
  • Tire damage (tires are excluded from most cargo policies)
  • Damage resulting from improper vehicle preparation
  • Damage caused by weather events (force majeure events)
  • 'Diminution in value' claims (reduction in resale value of a repaired vehicle)
